These General Terms and Conditions of Sale apply to all purchases of Products, made at a distance by electronic network via the site www.delidiofficial.com hereinafter referred to as 'the Company',

Preamble

The General Terms and Conditions of Sale set out below apply to all orders and/or pre-orders placed via the site www.delidiofficial.com, by e-mail or by telephone with DELIDI. They are available at any time on the Site.

The General Terms and Conditions of Sale may be subject to change and each Customer must consult them before proceeding with any purchase. It is the Customer's responsibility to check the General Terms and Conditions of Sale before placing an order. Consequently, placing an order implies full acceptance, without reservation, of these General Terms and Conditions of Sale.

DELIDI Products are intended exclusively for sale to final Consumers, natural or legal persons, excluding all resellers or intermediaries acting on behalf of resellers. Any resale or distribution of DELIDI Products purchased on www.delidiofficial.com is strictly subject to the prior written authorisation of the DELIDI Company.

     1. Purpose

These General Terms and Conditions of Sale specify in particular the various steps necessary for the placing of an order and/or pre-order by the Customer, the terms of payment and delivery, and also specify the follow-up of the Customer's order.

    2. Product Features

Only original Products are offered for sale on www.delidiofficial.com. Each DELIDI Product is sold with its own bears the serial number to confirm its authenticity.

The Products offered for sale through the Site are bags and accessories shown in the online catalogue at the time of ordering.

The catalogue of Products may be updated and modified periodically, therefore the permanence of a Product among those available online is not guaranteed. Items in the shopping cart are not reserved and can be purchased by other customers. Products for sale on the Site are available immediately or by pre-order.

All orders and/or pre-orders are subject to acceptance and availability. In the event that a Product is not available after placing the order, the Customer will be informed by e-mail or telephone as soon as possible, proposing to pre-order the same Product, order another item presented on www.delidiofficial.com as a replacement, or cancel the order.

In the event that the Customer chooses to cancel the order, he/she shall be immediately reimbursed the sums already paid, by crediting the bank account corresponding to the credit card used for payment.

The essential features of the Products are presented on www.delidiofficial.com in each Product sheet.

Due to the nature of the leather,the colour may vary and may sometimes it be subject to slight colour fading and/or colour transfer. Variations in the color of the grain or material and natural marks on the leather are not considered defects.

We do our best to present photos of the items as faithfully as possible, but the colour shades and rendering of the materials presented on the screen may vary from the physical Product. The images of the Products must, therefore, be understood as indicative and subject to normal tolerances in use. DELIDI explicitly disclaims any liability in this respect.

Our Gift Cards available in different amounts (50€, 100€, 250€, 450€) may be used for several purchases, in full or in part, alone or along other payment methods, as long as the card is still credited and are valid for 12 months from the date of transmission to the beneficiary.

Once the purchase has been made, the electronic Gift Card will be sent by e-mail directly on the day and to the the e-mail address you specified.

Upon request, we can send the paper version by post to the address of your choice. In this case, please indicate the shipping address next to the recipient's name.

  • Delidi Gift Cards are only issued in EUR €
  • No shipping cost upon checkout
  • Delidi Gift Cards are non-refundable, returnable nor redeemable for cash except as required by law
  • These cards cannot be purchased with a discount or gift card
  • These cards can only be used on our official website delidiofficial.com
  • If lost, stolen or damaged our cards are only replaceable if the customer is able to provide all necessary information and proof of purchase in order to retrieve the cards in our databases. In the event of replacement, the validity of the card will remain unchanged.
  • Delidi Gift Cards can be sent either in a digital version by e-mail, or in a paper version by post, but one option excludes the other.

    3. Sale Prices

The prices of the Products applied are those communicated on the Site and confirmed to the Customer during the order and/or pre-order validation. The sales prices indicated on the site wwww.delidiofficial.com are always expressed in € euros.

We reserve the right to change the prices of the Products offered on www.delidiofficial.com at any time and without prior notice, but we undertake to apply the prices indicated on the Site at the time of ordering and/or pre-ordering.

The obvious material error, whatever the reason (computer bug, manual error, technical error), reported in the price on the Site compared to the commonly known price of the Product chosen, shall entitle DELIDI - even if the order has been validated by DELIDI - not to confirm the shipment and proceed with the cancellation and immediate refund of the value of the purchase paid by the Customer, of which the Customer will be informed as soon as possible. The Customer may then, if he or she so wishes, place the order again at the correct and exact price.

For the EU, all prices shown include French value added tax (VAT). Outside the EU, all prices are shown exclusive of VAT. Depending on the country, additional local taxes may be required and will be charged to the customer. Customs costs and payment of any duties or taxes are the responsibility of the Customer.

Any delivery costs are indicated to the Customer directly in the "shipping" section. In any case, the total cost of shipping will be made known to the Customer before the purchase is confirmed.

     4. Purchasing methods

The website www.delidiofficial.com allows you to order and/or pre-order your original products online from DELIDI.

DELIDI only offers limited series on its site, produced as much as possible according to customer requests, to avoid unnecessary waste or overproduction. For this reason, for some of the most popular products, delivery times can vary from 2 to 8 weeks.

If the Product is in stock, the Customer can simply add it to the shopping cart and make the payment. In this case, the order will be processed within a few days.

DELIDI provides the Customer with a pre-order system for some Products in case they are not in stock. In this case, the Customer can still purchase the Product by adding it to the shopping cart using the "Pre-order" button on the Product page and finalise the purchase by payment. In addition, a note will be displayed in the shopping cart to indicate that the Product is being purchased by pre-order. The Customer will then have to wait for production time, which may vary between 2 and 8 weeks, before receiving the Product. In any case, the customer will be informed as soon as the Product is available to be shipped.

In order to proceed with the online purchase of one or more Products, the Customer may first register on the Site or conclude the purchase as a Guest Customer, providing DELIDI, in compliance with data protection regulations, all data necessary to enable the latter to execute the orders placed.

The purchase is made through the exact completion and consent to the purchase manifested through the electronic transmission of the Order Form as well as through the payment of the price of the Products placed in the shopping cart (for both orders and pre-orders). The transmission of the form and the payment transaction imply that the purchaser unconditionally accepts and undertakes to comply with the provisions of these General Terms and Conditions in his relations with DELIDI.

Please note that for all orders placed via Internet, accurate and complete information must be provided at the time of ordering, such as surname, first name, telephone number, e-mail address, billing and delivery address, and all elements required to register and dispatch the order.

A confirmation e-mail with a summary of the order and/or pre-order (Products, price, availability of Products, quantity, order preparation time) will be sent to the Customer by DELIDI. To this end, the Customer formally accepts the use of e-mail for confirmation of his/her order by DELIDI. The Customer has 14 (fourteen) calendar days to exercise the right of withdrawal from the delivery of the package.

DELIDI reserves the right not to accept an order and/or pre-order from a Customer with whom there is a dispute over a previous order, or if DELIDI reasonably believes that such Customer has violated these Terms and Conditions or has engaged in fraudulent activity, or for any other legitimate reason. In such cases, the Customer will receive a specifically reasoned rejection of the order by e-mail.

     5. Payment Methods

In order to proceed with the purchase on www.delidiofficial.com, it is necessary to proceed with the payment of the Products placed in the shopping cart, whether it is an order or a pre-order.

To proceed with the payment of the Products' price and related shipping and delivery costs, if any, the Customer may choose one of the methods indicated in the Order Form at the time of purchase on www.delidiofficial.com.

Payment is made online, in euro €, by credit card. The following credit cards are accepted: Visa, Mastercard, American Express, Apple Pay, Shop Pay, PayPal. The order will only be dispatched once the payment method has been verified and the card has been authorised.

In the event of non-payment, incorrect address or any other problem with the Customer's account, DELIDI reserves the right to block the Customer's order until the problem is resolved.

  1. Shipping Methods

Delivery Times

During the ordering and/or pre-ordering process, the Customer will be informed of possible delivery times and shipping options for the purchased Products for the chosen delivery country. Delivery times include working days only and do not include holidays.

If the ordered Product is available, orders are sent on average between 48 and 72 hours after confirmation of order payment , but this period may exceptionally be extended to 15 (fifteen) working days in some specific cases.

If the Product is not in stock, and is purchased by the Customer via pre-order, DELIDI reserves 2 to 8 weeks for production and will inform the Customer immediately by email as soon as the Product is ready for dispatch.

The Products shall be delivered to the address provided by the Customer at the time of order by one of our delivery services within a maximum of 30 working days after collection of the package.

For these deadlines to be met, the Customer must ensure that he has provided accurate and complete information on the delivery address (such as, in particular: house number, building number, number of stairs, access codes, names and/or intercom numbers, telephone number, e-mail address, etc.).

If the delivery time is exceeded and is not justified by a case of force majeure, the Customer has 14 (fourteen) days from the expiry of the maximum delivery period (30 days) to request cancellation of the sale and reimbursement of the amount paid. To be considered, this request must be notified by e-mail to our Customer Service delidi@delidiofficial.com.

DELIDI cannot be held responsible for the consequences of a delay in delivery not attributable to DELIDI (customs...). 

Any complaint submitted after the stipulated 14 (fourteen) days cannot be taken into consideration.

However, any defect or delay in delivery of more than seven (7) working days must be reported as soon as possible to our Customer Service delidi@delidiofficial.com.

If the receiver is absent when the courier arrives, the person in charge shall leave a notice, in order to reschedule the shipment at a later date, indicating the contact details to be contacted in order to agree on a second delivery. In the event of failure to agree on a second delivery, the package shall remain in deposit at the courier's warehouse and it shall be the Customer's responsibility to arrange for collection.

If the package is not collected, it will be returned to DELIDI. In this case, the contract shall be considered terminated by DELIDI's communication sent by e-mail to the Customer and the order shall be cancelled.

Delivery methods

Once the order has been processed, the Product(s) to be shipped to the Customer are prepared and the package is scheduled to be collected by one of our contracted couriers.

Delivery is made to the delivery address indicated by the Customer (Monday to Friday), specifying that this must be the address of residence of the Customer, a natural person of his choice or a legal entity (delivery to his company). Delivery can not be made to hotels or post office boxes.

An e-mail with the tracking number will be sent by DELIDI to the Customer so that the latter can follow the dispatch of his package at any time.

The Customer must check the conformity of the Products at the time of delivery and indicate, if possible, on the delivery note, handwritten reservations accompanied by his signature regarding any anomalies found (open packaging, damaged Product, etc.).

In the event of non-conformity of the purchased Products or if the Customer is not satisfied with them, he/she may return them or request an exchange or refund under the conditions indicated in the section 'Returns, Exchanges and Refunds'.

The determination of the returns conformity with respect to the original condition of the Product and packaging sent is left to the sole discretion of DELIDI.

Unfortunately DELIDI cannot deliver to all countries. The Customer may contact the Company at delidi@delidiofficial.com for additional information about shipping to the desired destination country. 

Delivery costs / returns

Delivery costs and types may vary depending on the country and the shipping method chosen by the Customer.

These charges and any additional costs shall be charged to the Customer, except for promotional offers or specific cases defined on the occasion by DELIDI. In any case, the applicable amount will be expressly and separately indicated in the order summary, before the Customer proceeds with the order transmission, as well as in the order confirmation e-mail.

The Customer can choose between the following delivery methods:

Shipping ITALY and FRANCE : 10 €*

EU shipping : 15 €*

Standard international shipping : 45 €*

* The shipping costs indicated above are valid for a standard parcel. In the case of multiple purchases requiring a larger package, the shipping costs may require an additional charge, which will be indicated to the Customer by email before the order is shipped.

    7. Returns, Exchanges and Refunds

If you wish to exchange or return an item, please contact Customer Service at the following e-mail address: delidi@delidiofficial.com.

Please note that returns are possible on goods purchased at full price, unused and in perfect condition in their original packaging, and with a return request within 14(fourteen) days from the date of delivery of the goods. The item must also be accompanied by an invoice and its certificate of authenticity on which the serial Product number is indicated. The goods must be sent to the following address by signed courier:

DELIDI reserves the right to accept or reject the return depending on the state of the Product. 

If the return is not accepted, it will be sent back at the Customer's expense and no refund will be issued.

In the event that the return is accepted, the Customer may request one of the solutions listed below :

  • To receive a Product of the same or equivalent value (depending on availability) 
  • To receive a Product of a different value (depending on availability) by paying the complement or being reimbursed the difference in price
  • To receive a purchase voucher of equivalent value, valid for 1 year from the date of issue
  • To receive a full refund of the price of the Product ordered and any initial delivery charges. This refund will be made within 14 (fourteen) days after DELIDI receives the returned item, by crediting the Customer's bank account used to pay for the order.

It is specified that the return shipping costs shall be charged to the Customer, unless the item is defective and the defect is acknowledged by DELIDI.

Delidi Gift Cards are non-refundable, returnable nor redeemable for cash except as required by law.

International orders: for international orders, shipping, customs duties and sales taxes are non-refundable by DELIDI.

Please note that if an item is returned because the Customer has refused to pay any import taxes or customs duties owed, DELIDI will deduct from the refund total any costs or fees incurred by DELIDI and the refund will only be issued once the Product has been returned to the headquarters.

DELIDI shall not be liable for the loss, misdirection or delay in the delivery of a Product that you wish to return, as the risks of transport chosen and initiated are the sole responsibility of the Customer.

The return request must mandatorily contain the following information concerning the person who placed the order :

  • Customer's name
  • Order number
  • Shipping address
  • E-mail address and telephone number

    8. Guarantees

Products sold on the www.delidiofficial.com website are subject to the legal guarantees provided for in Articles l 211-4, l 211-5 and l 211-12 of the French Consumer Code and Articles 1641 and 1648 of the French Civil Code:

Art. L. 211-4. of the Consumer Code: "The seller is obliged to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made responsible by the contract or was carried out under his responsibility".

Art. L. 211-5. of the Consumer Code: "To be in conformity with the contract, the goods must: 1° be suitable for the use that is customarily expected of similar goods and, if applicable: a) correspond to the description provided by the seller and possess the qualities that the seller has presented to the customer in the form of a sample or model; b) possess the qualities that a customer can legitimately expect in view of the public statements made by the seller, the manufacturer or its representative, particularly in advertising or labelling. 2° Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use requested by the Customer, brought to the knowledge of the seller and accepted by the latter.

Article L. 211-12 of the Consumer Code: 'The action resulting from the lack of conformity is prescribed in two years from the delivery of the goods.

Art. 1641 of the Civil Code: "The seller shall be liable for hidden defects in the thing sold that render it unfit for the use for which it was intended, or that so diminish that use that the customer would not have bought it, or would only have paid a lower price for it, had he known of them.

Art. 1648 para. 1 of the Civil Code: "An action for redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.

DELIDI products are made of leather, which means that each leather is unique and has its own specificities in terms of colour, natural marks and streaks, and the appearance of the leather may have small imperfections.

Furthermore, due to its nature, the colour may vary and may sometimes it be subject to slight colour fading and/or colour transfer.

Skin irregularities, changes/colour loss and/or colour transfer and small imperfections are not considered defects.

DELIDI cannot guarantee or represent that the information contained on the Site is accurate, complete or up-to-date.

The Site may contain technical inaccuracies or other defects, DELIDI does not guarantee that such defects will be corrected. The website www.delidiofficial.com and its contents are presented "as is" and "as available".

DELIDI expressly excludes all warranties of any kind, whether express or implied, and in particular, without this list being exhaustive, all implied warranties of conformity or suitability of the www.delidiofficial.com website or its content for a usual or specific use, of its quality or of the absence of infringement of any provision.

    9. Responsibility

In any event, DELIDI shall not be responsible for any indirect, incidental, special or consequential damages, including, but not limited to, loss of business, loss of profit or loss of opportunity arising out of the purchase of DELIDI Products purchased from www.delidiofficial.com.

DELIDI disclaims any liability for inefficiencies attributable to force majeure or for damages inherent in the use of the Internet network, in particular an interruption of service, an external intrusion or the presence of computer viruses, or any event qualified as force majeure, in accordance with the law and the case law of the French courts. In the event that a force majeure event prevents the performance of these GTCS, DELIDI shall inform the Customer within fourteen (14) days of the occurrence of such an event, by e-mail or registered letter with acknowledgement of receipt. Expressly considered as force majeure or fortuitous events, in addition to those normally considered by the jurisprudence of the French courts and tribunals, are total or partial strikes, lockouts, riots, boycotts or other industrial action or commercial disputes, civil unrest, insurrections, wars, bad weather, epidemics, blockage of means of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal or regulatory changes in forms of marketing, computer failures, blockage of telecommunications, including wired or wireless telecommunications networks, and any other event beyond the control of the parties that prevents the normal performance of the contractual relationship.

All obligations of the parties are suspended for the duration of the force majeure event, without compensation. If the force majeure event lasts for more than three (3) months, the transaction in question may be terminated without compensation by either party.

Similarly, DELIDI shall not be responsible for any fraudulent or illegal use that may be made by third parties of credit cards, cheques and other means of payment when paying for Products.

    10. Obligations of the purchaser

The data entered at the time of purchase must only be one's own real personal data and not that of a third party, or fantasy data.

It is strictly forbidden for the purchaser to enter false, and/or invented, and/or fictitious data in the registration procedure required to activate the process for the execution of this contract and the related further communications. DELIDI reserves the right to prosecute any violation and abuse, in the interest and for the protection of all consumers.
The Customer indemnifies the Company from any liability arising from the issuance of erroneous tax documents due to errors in the data provided by the Customer, being the Customer solely responsible for their correct entry.

It is strictly forbidden for minors to place an order on the Site.

Upon receipt of the Products, the Customer shall verify their conformity in relation to the order. In particular, he/she shall pay attention to the correspondence between the number of packages indicated on the carrier's letter and those delivered and to the integrity of the packaging.

Any anomalies (e.g. tampering, damage) must be specified in writing directly in the courier's transport document and the Customer must refuse the delivery.

At the same time, the Customer shall immediately report the fact to DELIDI's Customer Service by sending an e-mail to delidi@delidiofficial.com.

Should the Customer accept delivery of tampered, damaged Products, he will forfeit the legal guarantee of conformity of the Products.

   11. Right of Withdrawal

The customer may exercise the right of withdrawal by returning the goods received and obtaining a refund of the price paid. Check the conditions for the right of withdrawal in the 'Returns, Exchanges and Refunds' section.

    12. Applicable law

All orders are subject to the Customer's acceptance of the General Terms and Conditions of Sale, which are subject to French law. In the event of a dispute or claim, we ask the Customer to first contact Customer Services to try to find an amicable agreement.

In the event of a dispute, the French courts will have exclusive jurisdiction to resolve it.

   13. Legal information

Please note that the secrecy of correspondence is not guaranteed on Internet and that it is up to each Internet Customer to take all appropriate measures to protect his or her own data and/or software from contamination by any viruses circulating on the Internet or from hacking.

  1. Personal Data and Cookies 

The data communicated by the Customer on the Site, necessary for the processing and delivery of orders, are reserved exclusively for DELIDI or its partners with the Customer's express consent.

At any moment during the purchase process, DELIDI is unable to know the Customer's credit card number, which, by opening a secure connection, is transmitted directly to the bank service provider. Transactions are handled entirely by Paypal, Stripe or the secure payment module of our banking partners. The Site uses cookies (connection cookies), of which the Customer is informed when he/she arrives on the Site, which allow information relating to the navigation of the computer on the Site to be recorded. These cookies are installed only after acceptance by the Customer; continued navigation on the Website is considered as acceptance. The Customer may object to the use of these cookies by configuring his or her browser, knowing that access to certain services may require the prior acceptance of cookies by the Customer.

The Customer may subscribe to DELIDI's newsletter and thus choose to be regularly informed of the offers proposed by the brand. The Customer may unsubscribe at any time by clicking on the appropriate link in each newsletter.

The Customer may also contact Delidi via the Contact Form on the Site for which acceptance of the Privacy Policy (available on the Site) is required.

Some web pages on the Site may contain web beacons that allow you to count the number of visitors to the Site and/or provide DELIDI with a number of indicators. These web beacons may be used with some of our partners, in particular to measure and improve the effectiveness of the Site. In any case, the information obtained from these tags is only used to collect statistics on the number of visitors to certain pages of the Site in order to better serve our Customers.

   15. Intellectual Property

The contents of this Site, including but not limited to: information, software, code, data, text, photographs, graphics, videos, images, logos, product/service names, trademarks, domain names, designs, and any other type of content on this Site, are and will remain the exclusive property of DELIDI. This means that the reproduction, partial and/or total, distribution, publication, transmission, any modification and sale of any content on this Site is strictly prohibited.

Only the exclusively personal and non-commercial use of any content on this Site is authorised: such use, in any case, does not confer any title, right or interest in the content on DELIDI's Site. Therefore, any use other than that authorized above is prohibited and will constitute a violation of the rights of DELIDI.

  1. Modifications

These General Terms and Conditions of Sale apply as long as they are published on www.delidiofficial.com.

DELIDI reserves the right to change the Site, its policies and these General Terms and Conditions of Sale at any time in order to offer new Products or services, or to comply with laws or regulations. The Customer who accesses the Site and places an order will adhere to the policies and terms of the General Terms and Conditions of Sale in force from time to time at the time the order is placed, unless any changes are retroactive under applicable law. Should any of these provisions be held invalid, void or unenforceable, this shall not affect the validity and enforceability of the other provisions.
